Medico Abroad Consultants, Hyderabad, India welcome the judgment of Hon’ble High Court of Delhi delivered on 27.09.2018 which benefits the Indian students desiring to pursue Foreign MBBS. The decision of the Court allows old procedure of applying for Eligibility Certificate in the case of students who did not appear in NEET or appeared and did not qualify in NEET. The important text of the judgment is as under:
“In the judgment delivered by the Hon’ble High Court of Delhi on 27.09.2018 in W.P.(C).No8091/2018, it was pronounced that the denial of the one-time exemption to those who could not qualify, but appeared in NEET, has resulted in unfairness. Both categories (those who appeared but failed to qualify and those who did not appear) fall in the same class, i.e. candidates who did not qualify in NEET after 31st May, 2018.
The court declared that the petitioners are entitled to the same treatment as was given to those who did not appear in NEET; as a one-time measure, the respondents (i.e., MCI or the competent authority) are directed to ensure that eligibility certificates are issued to all students who appeared in NEET (including the petitioners) but did not qualify the test.”
